802.11a North American Standards

Can someone explain the difference in how the FCC ISM rules are used with

802.11a? I've been dealing with a question about channel 165 (5.825GHz) which I don't think is included in the U-NII upper band, but a lot of WLAN devices do list it.

"difference"? Difference to what?

15.403 definition (s) U-NII devices. Intentional radiators operating in the frequency bands 5.15?5.35 GHz and 5.470?5.825 GHz that use wideband digital modulation techniques and provide a wide array of high data rate mobile and fixed communications for individuals, businesses, and institutions.

Channel 165 @ 5.825GHz must therefore be included.

It was revised in December but I haven't done a line by line check to see if there were any differences.
