The law says "with INTENT to annoy". So it's OK to annoy someone if that wasn't your intent.

I think the spammers' intent is to get your money, the annoyance is just an unintended side effect.

If this were a civil issue, perhaps a class action lawsuit against all spammers would be appropriate, since as a group they clearly know they're annoying us due to the combined volume.
