I've been capped like 3 times before. I think if I am again they'll terminate me or something. They wont say how long it takes before they do it. Is it like 5 minutes, an hour? Or does it go by speed?

How long can you upload before Optimum Online caps?

No one knows except them and they don't specify the threshold at which you go past the acceptable use policy. Unless you're still one of the few running a file-sharing platform like BitTorrent, I'm not sure how you could be coming upon those issues. They only care if you're doing a large amount of uploading, as a rule.
As far as your last question, it's the total bandwidth you use, not your speed, which you can't control anyway.
